Advertising: Nestlé fined in Vietnam over misleading Milo milk advertisement

Nestlé Vietnam has been fined VND 80 million (US$3,077) and ordered to immediately remove promotional materials for its Milo barley milk after Dong Nai police ruled the company’s claims were misleading, Tuoi Tre has reported→view source.

The advertisement used unsubstantiated phrases like “best” and “only,” which authorities said could confuse or deceive consumers, violating the Law on Protection of Consumer Rights.

Key details:

  • Offence: Use of superlative and exclusive claims without legal substantiation.
  • Penalty: VND 80 million fine; required removal of ads across digital and print media.
  • No criminal charges: Police ruled the case lacked sufficient grounds for prosecution.
  • Compliance deadline: 10 days to remove content; interest applied on late fine payment.

Foreign firms should note that marketing claims must be backed by documented evidence, especially for products targeting children or health-conscious consumers; and that enforcement of advertising standards and consumer rights does happen.
