Intellectual property: Vietnam moves closer to launching specialised IP court

A draft resolution on court establishment and jurisdiction in Vietnam, to include specialised IP courts, has been submitted for review, targeting a 1 July 2025 effective date, Mondaq has reported→view source.

Key details:

  • Legal basis: IP Court authorised under Law on the Organisation of People’s Courts, effective 1 January 2025
  • Jurisdiction: Planned two regional IP Courts — Hanoi-based (20 provinces and cities), HCMC-based (14 provinces and cities)
  • Scope: First-instance jurisdiction for IP-related civil and administrative cases, enforcement of judgments
  • Related courts: Draft also outlines regional courts for Bankruptcy and Economic disputes
  • Timeline: If passed on schedule, the IP Court could begin operations by late 2025 or early 2026

This is a key step towards providing businesses in Vietnam with a dedicated legal forum for IP protection and enforcement. 

However, with the resolution still under review, the timeline for the IP Court’s actual launch remains open.
